# GENERAL TERMS AND CONDITIONS AND RATES

These General Terms and Conditions regulate access to, browsing and use of the web platform **[www.eslanzarote.com](http://www.eslanzarote.com)**, as well as the contracting of tourist accommodation services offered through it.
The owner and legal representative of the website is **Eslanzarote Sostenible SL**, hereinafter, **“eslanzarote.com”**.
Acceptance of these Conditions implies that the User:
* Has read, understands and comprehends its content.
* Assumes all the obligations established herein.
* Declares to be of legal age and have sufficient legal capacity to contract.
If the User does not agree with these Conditions, they must refrain from using the website and contracting the services offered.
The electronic contract **will not be filed by a third party** and the language of contracting is **Spanish**.
These Conditions may be saved and reproduced by the User and **must be expressly accepted before proceeding with the payment of the reservation**.

## Booking Process
The booking process on "eslanzarote.com" consists of the following steps:
1. Selection of the check-in and check-out dates of the accommodation.
In case of unavailability, the system will automatically notify it.
2. Completion of the form with the User's personal data.
3. Making the corresponding payment.
Once the reservation is confirmed, the User will receive an email with:
* Complete booking details
* Confirmation code
* PIN code for transactions
* Proof of purchase or invoice
If the email is not received within 24 hours or there is any error, the User should contact **[[email protected]](mailto:[email protected])**.

## Payment Methods
Payment is made by **credit or debit card**, through a **secure payment gateway** managed directly by the bank.
"eslanzarote.com" **does not store or manipulate bank data**, guaranteeing maximum security, confidentiality and transparency in the transaction.

## Prices, Taxes and Fees
The prices of the accommodations and services offered on "eslanzarote.com" are shown in the corresponding descriptive sheet and are expressed in **euros (€)**.
**Peninsula, Balearic Islands and Canary Islands:**
The published prices **include the Canary Islands General Indirect Tax (IGIC) at the current rate of 7%**, applicable to tourist accommodation services provided by "eslanzarote.com".
The indicated price constitutes the **total final price**, there are no mandatory additional charges unless expressly indicated during the booking process.

## User Registration
In order to make reservations, it may be necessary to create a **User Account**.
From their account, the User may:
* Consult the history of reservations and invoicing
* Modify personal data
* Change the password
* Correct errors in the information entered
The User agrees to use the platform **exclusively for private purposes**, unless expressly consented to in writing by "eslanzarote.com".

## Cancellation and Modification of the Reservation
### (Economic conditions and penalties)
In accordance with article 103.l) of Royal Legislative Decree 1/2007, **the right of withdrawal is not applicable**, as it deals with accommodation services with a specific date or period of execution.
However, "eslanzarote.com" establishes the following **cancellation conditions**, differentiated by type of accommodation.

### General Payment Conditions
* At the time of booking, the client will pay **50% of the total amount** as a **deposit**.
* This deposit is **non-refundable**, unless expressly indicated in these conditions.
* The **remaining 50%** must be paid **before arrival at the accommodation**, according to the booking instructions.

## 🏢 Apartments – Standard Rate
1. **Cancellation up to 15 days before check-in**
* The client may cancel the reservation.
* **The 50% paid as a deposit will not be refunded**.
2. **Cancellation within 15 days prior to check-in**
* A **penalty of 100% of the total amount of the reservation** will be applied, without the right to a refund.
3. **No-Show**
* Failure to appear on the scheduled date of arrival will imply a **charge of 100% of the total amount**.

## 🏡 Villas – Standard Rate
1. **Cancellation up to 30 days before check-in**
* The client may cancel the reservation.
* **The 50% paid as a deposit will not be refunded**.
2. **Cancellation within 30 days prior to check-in**
* A **penalty of 100% of the total amount of the reservation** will be applied, without the right to a refund.
3. **No-Show**
* Failure to appear will imply a **charge of 100% of the total amount**.

## Modification of the Reservation
* Modification requests are **subject to availability** and must be made in writing.
* Modifications **do not alter the cancellation conditions** originally accepted.
* "eslanzarote.com" reserves the right to accept or reject modifications for operational reasons or proximity to the arrival date.

## Emergency Services and Extraordinary Services
"eslanzarote.com" offers, **optionally**, certain **emergency or extraordinary assistance services**, which are **not included in the price of the accommodation**, and which may be requested during the stay.
These services are provided **at the express request of the client** and are subject to availability.
### Services Considered Extraordinary (by way of example):
* **Loss or forgetting of keys**, travel to open the accommodation or delivery of new keys.
**Base price:** €50 per intervention.
* **Urgent assistance not related to the property**, understood as any action requested by the client that does not derive from a defect, breakdown or incident attributable to the accommodation or "eslanzarote.com".
### Surcharge for Special Days
Extraordinary services will have an **increase of 40% over the base price** when they are provided on:
* Weekends
* Local holidays
* Regional holidays
* National holidays
### Payment Conditions
* The amount will be informed beforehand whenever the urgency allows.
* The service must be paid **immediately**.
* The request for the service implies the **express acceptance of the applicable cost and surcharges**.
### Exclusions
Services derived from defects or incidents attributable to the property or "eslanzarote.com" will not be considered extraordinary services, which will be attended to **without additional cost**.

## Account Deletion, Service Cancellation and Blocks
User accounts are not deleted due to inactivity.
The cancellation may be requested by email to **[[email protected]](mailto:[email protected])**.
In case of non-payment:
* The service may be temporarily suspended.
* After 15 days, it may be definitively cancelled, without exempting the User from the payment of the services enjoyed.
"eslanzarote.com" may block or delete accounts for illegal, fraudulent use or breach of these Conditions.

The User has the **European Online Dispute Resolution Platform**, in accordance with Regulation (EU) 524/2013:

## Applicable Law and Acceptance
This contract is governed by **Spanish law**, in particular:
* Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE)
* Royal Legislative Decree 1/2007, General Law for the Defense of Consumers and Users
These Conditions may be modified at any time.
**Those in force at the time of contracting will be applicable**.
